KARACHI: A customs appellate bench of High Court of Sindh comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan on Friday stayed an auction notice issued by the Model Customs Collectorate, East to Humak Engineering Private Limited while issuing notices to respondents for July 8 as earlier petition is also fixed on that date.
The petitioner company imported nine consignments of air-conditioners which landed at the port in March 2019 but could not be cleared due to a dispute over duty and taxes. The Deputy Collector, MCC East issued a notice for auctioning the said goods on June 01 which was impugned in the instant petition.
Ms Dil Khurram Shaheen advocate appearing for the petitioner appearing before the bench submitted that the new petition is identical in nature as some BLs are left out. She said that the importer is ready to pay the custom duty, taxes etc and the Goods Declaration filed by them is now under process. She prayed to the court to stay the auction proceedings.
The bench after hearing initial arguments suspended the auction notice while issuing pre-admission notice to the respondents for July 08.
