KARACHI: A customs appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan on Monday while hearing a constitutional petition challenging imposition of Regulatory Duty allowed provision release of consignments imported by Hikmat Traders.
Sohail Hameed advocate appearing for the petitioner challenged what he termed the unfettered exercise of authority under section 18 of the Customs Act 1969 by imposing SRO 1265 (1) of 2018.
The respondents include Federal Secretary Finance, Chairman FBR, Chief Collector, MCC East, Collector Appraisement West and Collector Customs, Port Muhammad Bin Qasim.
The bench later after a brief hearing allowed provisional release of consignments while fixing May 31 for detailed hearing.
