Karachi: A customs appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan on Thursday disposed of a petition filed by Jamal Apparels with direction to the Preventive Collectorate to release the consignment of textile goods having stamps other than of T.L.Sharma.
Earlier a report was submitted by Nazir of the court prepared in assistance with an expert from Pakistan Textile Institute which said that except 93 items, the rest of the cloth is of Pakistani or local origin.
The bench was told that the statement of local manufacturers were also recorded.
A lawyer from Franklin Law Associates told the court that Lab Text report is also in favour of the petitioner. He also submitted that custom authorities cannot raid any premises without warrants after issuing notice under section 163 of the Customs Act 1969.
The bench after a detailed hearing ordered respondent custom officials to release the goods with local stamps while decide the case of 93 packets as per law.
