KARACHI: A custom appellate bench of High Court of Sindh (SHC), comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan dismissed as not pressed a petition pertaining to three imported consignments of three wheeler autoloader 150 CC, (rickshaw) filed by M/s Rehman Auto Industry, Bahawalpur for manufacturing and assembling.

The petitioner challenged the assessment of consignments under PCT Heading 8704.3140 by the respondents including Collector Custom, MCC East and Additional Collector–IV chairperson, Classification Committee, MCC East.

In the meantime petitioner complied all requirements for import of three wheeler auto loader as per SRO 656(I)/2006 and obtained certificate from EDB, as per FBR rules, hence the petitioner the counsel for petitioner appearing before the bench stated that purpose of filing the petition has been served and they have complied with all the mandatory requirements.

Khalid Rajpar advocate appearing for the respondent customs department said department has no objection as petitioner has complied with requirement of custom and other laws.

The bench after this statement dismissed the petition as not pressed as complied with SRO 656/2006.

Whereas another CP of M/s Orange Motors, CP No.4001/2018, is pending which is fixed for hearing on 08-11-2018, wherein petitioner is contending that they don’t require to complete FBR and customs legal requirements and they don’t claim exemption, but the same is compulsory legal obligation which cannot be thrashed out.

The hearing of an identical petition by another importer M/s Orange Motors Pvt Ltd was adjourned by the same bench as it has not complied with the mandatory requirements.
