KARACHI: Justice Muhammad Ali Mazhar of High Court of Sindh on Monday deferred hearing of a petition against heavy demurrage worth rupees 3 Crore in respect of five construction vehicles detained/parked at Karachi International Container Terminal (KICT), till June 04.
The bench was hearing a petition filed by Rising Sun Construction Company through Ms Dil Khurram Shaheen advocate who referred to an order dated 31-5-2017 by a custom appellate bench which as an interim relief ordered the release of prime movers till decision in SCRA filed by the department.
The counsel for petitioner submitted that delay in release of vehicle was not due to petitioner/importer and thus vehicle are liable to be released.
The counsel for KICT opposed the plea stating that they have obtained a stay order and vehicles could be released only on payment of demurrage.
The bench later asked the counsel for petitioner to submit a statement that how much they can pay towards demurrage for settling the matter in hand. The bench fixed June 04 for deciding the case.
