ISLAMABAD: A full bench of Supreme Court of Pakistan (SCP) comprising Chief Justice of Pakistan, Justice Faisal Arab and Justice Sajjad Ali Shah deciding an appeal filed by Collector Custom, Appraisement, Karachi against an order of the Special Customs Appellate Tribunal held that it feel no need to interfere with the impugned order.

The appellant, custom department assailed an order of the Special Customs Appellate Court which allowed the release of detained construction machinery. According to details, respondent, a construction company imported  old and used Mercedes Dump Truck under Non Repatriable Investment (NRI). The petitioner filed bill of entry for home consumption. After examination, the shed staff cleared the dump trucks but  detained/confiscated Prime Movers declaring them as banned item.

The apex court bench after hearing Raja Muhammad Iqbal advocate, counsel for appellant Pakistan Customs at length dismissed the appeal.
