KARACHI: Justice Muhammad Shafi Siddiqui of High Court of Sindh (SHC) ordered release of a consignment of Aluminium foils as per Valuation Ruling. The bench also ordered that net weight minus packaging shall be the weight for determination of customs duty and other levies.
The single judge earlier heard Ghulam Hyder Shaikh advocate of Franklin Law Associates representing petitioner M.F Enterprises who relying on case laws maintained that levy of duty on gross weight including packaging has been held illegal by this court.
The bench agreeing with the arguments of the counsel for petitioner ordered release of the consignment after re-assessment and valuation on the basis of net weight of the item imported.
Hearing another petition filed by Aleem Enterprises regarding exemption on LED lights ordered re-examination of the consignment and release after such re-examination. The bench also sought a compliance report by March 02, next date of hearing in the case.
