KARACHI: Director General Customs Valuation Syed Tanveer Ahmed has remanded the Valuation Ruling NO.900/2016 back to the Director of Customs Valuation for deciding it afresh on merit and in accordance with law.
M/s Silver Surgical Complex Pvt Ltd had approached the Director General Syed Tanveer Ahmed submitting that the valuation of tubular metal needles those are used in medical devices is fixed at much lower side as compared with international market.
The departmental representative (DR) could not reply to queries as to on what basis they fixed value at $7.5/kg from China. One packet of 1-2 kg contains 40,000 pieces.
The DR said that the website literature of manufacturers available in the file shows value of $0.01/pc to $0.3/pc.
The weight of 40,000 pc needle pack is 1.69 kg. In case of insulin needle the number are 80,000 per packet even if $0.01/pc value is taken the price of one packet goes upward.
Syed Tanveer Ahmed noted the contention of the manufacturer is correct that they are importing needles at $24 – $30/kg. Even considering the transaction value, the valuation ruling should have been around $30/kg instead of $ 7.5/kg.
The impugned valuation ruling No.900/2016 is remanded back to the Director of Customs Valuation for deciding it afresh on merit and in accordance with law and that too after giving the applicant a fair opportunity of hearing within 10 days of issuance of this order.
