KARACHI: An appellate bench of High court of Sindh (SHC) comprising Justice Munib Akhtar and Justice muhammad Humayun Khan on Friday ordered release of consignments while hearing three identical constitution petitions.
Best Hope Enterprises, Ashraf Traders and Adil traders moved the court against Pakistan Customs, Valuation department on ground that the Director General Valuation in excess of jurisdiction enhanced the value of the imported goods while passing an Order in Revision.
Talal Taqir Khursheed of Franklin Law Associates appearing for the petitioners submitted that the DG valuation has no powers to determine or enhance the value. He relied upon an order dated 9-9-2016 passed by SHC in a petition CP-D 4970 of 2016 and sought identical relief of interim arrangement for release of the consignments of the petitioners. As Appraiser Law M.Ilyas Ahsan do not raise any objection to the request for provisional release, the bench allowed the release in line with the orders passed by SHC in petition cited above.
The said order require the importer/petitioner to pay differential amount between declared value and Valuation Ruling to the satisfaction of the Nazir of SHC.
