KARACHI: An Income Tax Appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Abdul Maalik Gaddi issued pre-admission notices to the Commissioner Inland Revenue (Appeals I) and Additional Commissioner IR in an Income Tax Reference Application (ITRA) filed by Pakistan National Shipping Corporation (PNSC).
The appellant raised eleven questions of law but during hearing said that it will press only five questions pertaining to impugned order by the respondents pertaining to tax year 2003. The controversy pertains to filing of returns of Income Tax under section 120 of the Income Tax Ordinance 2001 but the Tax Officer proposed to amend the said assessment. The Tax Officer issued a show cause notice to the applicant for proceedings under section 122 (5-A) of Ordinance 2001.
The said order was maintained by the Appellate Tribunal for Inland Revenue (ATIR) while deciding an ITRA filed by the PNSC against which the instant reference is filed.
The bench will now hear the appeal in the last week of October.
