KARACHI: A division bench of High Court of Sindh (SHC) comprising Justice Munib Akhtar and Justice Anwar Hussain tagged a constitutional petition with a Special Customs Reference Application and adjourned hearing till first Sept 30.

The bench earlier heard counsel for the petitioner company New Light House who prayed for ex-bonding of the consignment from in-bonding (release). The counsel said that petitioner has paid all the customs duty, taxes etc.

Masooda Siraj advocate appearing for the Pakistan Customs opposed the plea on ground that petitioner has also filed a SCRA. She submitted that petitioner has made an attempt to deprive the government of legitimate revenue of rupees 7,311,923 due to non-application of Valuation Ruling no Misc/11/2007-IVC-/1537. She also maintained that petitioner has to pay a penalty of rupees 100,000 also. She alleged that petitioner/importer has imported seven consignments of Welding Electrodes AWSE 6013 falling under the HS Code 8311.1000  which carried lower values without applying the correct values ranging from US $ 670 per metric ton  to US $ 850.

The bench perused the series of litigation by the petitioner/importer and later while adjourning the further hearing ordered that the petition be tagged with the SCRA and put before this bench for a decision.
