KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Abdul Malik Gaddi on Tuesday dismissed three identical Income Tax Reference Applications (ITRAs) filed by Commissioner Inland Revenue, Zone III, Large tax Payers Unit pertaining to redeemed Income Tax.
Arshad Siraj Memon advocate appeared for the respondents/defendant insurance companies and relied on judgment 2011, PTD 2002 by SHC and other judgments and contended that reference applications are liable to be dismissed as superior courts have already decided the issue and made a distinction between the life insurance, general insurance and health insurance.
The applicant was represented by Amjad Javed Hashmi advocate challenging the order of the Income Tax Appellate Tribunal under section 132 (2) of the Income Tax Ordinance 2001. The bench after hearing the sides dismissed all the three identical references against Allianz-EFU and State Life Insurance Corporation.
