KARACHI: A divisional bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Abdul Malik Gaddi disposed of a Income Tax Reference Application (ITRA) filed by Motiwala securities against a demand raised by income tax department for rupees 2,269, 248.
According to petitioner a tax return was filed for the year 2005, with “Nil” taxable income refund claim. They later filed a refund claim under section 233 A (1)© of the Income Tax Ordinance 2001 and got rupees 12,369,248 under section under section 170 of IT Ordinance. Later they received a notice from the Add Cir, A, Audit Division I, RTO under section 122 (5-A) of ITO 2001 dated 5-8-2012 reopening their case on ground that a sum of rupees 2,269,248 pertained to the clients/customers of applicant/tax payer company.
The petitioner challenged the notice before the appellate forum which also rejected the appeal against which the instant ITRA was filed.
The SHC bench today after hearing the sides dismissed the same.
