KARACHI: A divisional bench of High Court of Sindh (SHC), comprising Chief Justice Sajjad Ali Shah and Justice Zulfiqar Ahmd Khan on Thursday disposed of a constitutional petition by importer of pvc pipes.

The petitioner challenging the valuation ruling said that Custom has released goods of identical description and same origin at a rate of US $.90 while four consignments of the petitioner were released at at rate of US $ 1.20 per kilogram.

Kafeel Ahmed Abbasi, counsel for petitioner submitted that petitioner was being discriminated and Valuation department is not ready to pay any heed to the appeal or requests made by the petitioner for re-assessment and issuance of new valuation ruling after a genuine market survey.

(Law) submitted that controversy pertains to the quality of the imported item as petitioner’s goods are manufactured of virgin material while those release consists of re-cycled pvc.

File an appeal and pursue the remedy, the bench observed after the statement by the Customs side. Director General, Valuation is supposed to tackle such issues, the bench observed.

The bench said that as remedy is still available to the petitioner, petitioner is being disposed of with the direction to the Director Custom Valuation to decide the appeal within 45 days after giving opportunity of full hearing to the petitioner.
