KARACHI: A divisional bench of High Court of Sindh (SHC) comprising Chief Justice Sajjad Ali Shah and Justice Zulfiqar Ahmed Khan on Friday issued notice for April 20 to Model Customs Collectorate (MCC), Hyderabad in a case of Oil tanker detained for carrying smuggled Iranian Oil.
The adjournment came as counsel for Customs Kashif Nazeer submitted that case pertains to MCC Hyderabad and therefore time is needed to seek comments.
Earlier Ms Dil Khurram Shaheen advocate appearing for petitioner Shabbir Ahmed stated that her client filed an appeal against confiscation of his oil tanker and the appellate authority ordered release of the tanker against fine at the rate of 20 per cent of customs duty.
The department challenged the order in original before the Special Customs Appellate Tribunal, which also dismissed the department’s case.
She said that petitioner was forced to file the petition for implementation of the order of the tribunal. It is a case of hardship as the tanker in custody of MCC Hyderabad is the only source of income of the petitioner, she said praying for an early hearing.
The bench at the request adjourned proceedings until April 20.
