KARACHI: Justice Muhammad Junaid Ghaffar of High Court of Sindh on Wednesday ordered release of a generator imported by a textile company against payment of differential amount of duties etc while fixing the further hearing of suit with 25 identical cases fixed for hearing on March 07.

The suit was filed by Kasim Textile Mills (Pvt) Limited who imported a generator to support their operation in the wake of frequent load shedding in the industrial areas of Karachi. The importer claimed an exemption from duties and taxes under SRO 575 of 2006, Serial no 11.

The Custom authorities however declined grant of exemption claimed based on a Clarification issued by the FBR through Secretary Tariff, The counsel for petitioner citing Collector Customs Port Muhammad Bin Qasim, Collector Model Customs Collectorate East t and West prayed to the court to order release of the imported consignment saving the petitioner/importer from heavy demurrage.

The bench today after hearing arguments in detail by counsel for plaintiff as well as Masooda Siraj advocate representing Custom Valuation ordered release of the consignment after payment of government dues while further hearing will be held on March 07 with 35 other identical suits.
