KARACHI: The Director General (DG), Customs Valuation, Samaira Nazir Khan rejected revision petitions against Valuation Ruling No. 777/2015 December 12, 2015.
The revision petition was filed by DFB Gypsum Industries Karachi under section 25-D of the Customs Act 1969 against Customs value of Gypsum Board and Fibre Cement Board imported from China, India and Thailand origin, vide Valuation Ruling no 777/2015 issued by Director, Customs Valuation Karachi.
The petitioners maintained that the VR 777.2015 aggrieved them as these were determined without consideration of present market situation and without considering the freight charges of different exporting origins.
The transaction values of the applicant are absolutely in accordance with the law and covering all aspects of the goods.
The respondent Director Customs Valuation in its reply submitted that petitioner submitted no documentary evidence such as Goods Declaration in support to justify the claim. The petitioner’s claim of Gypsum Board of UAE origin could not be accepted as evidence as this is older than 90 days from the days of issuance of VR. The Turkey Board could not also be accepted as evidence and this was 90 days older from the date of issuance of VR.
The Director General, Customs Valuation while rejecting the revision petition held that petitioner failed to prove their case through documentary evidence and did not put forward any relevant data during the meeting for determination of Customs values of Gypsum Board, Gypsum Tiles and Fibre Cement Board.
The order said the local market survey had been conducted before issuance of VR and no obvious change was detected.
In view of said facts available on record, the petitioner did not put forward any solid arguments therefore, Customs values determined were according to the law and hence review petition was hereby rejected.
