KARACHI: The Customs Adjudication has penalized a ceramics importer for willfully misdeclaring size and quantity of the goods in order to evade duty/taxes.
According to the details of the case, M/s Aman Ceramics imported a consignment of tiles and sought clearance. On physical examination, it was found that the imported goods were in excess quantity as declared in the GD.
It was revealed that the goods are actually imported in excess quantity 7367.95 SQM (63.314 % excess). Therefore, the importer has willfully and deliberately Mis-declared the size and the quantity.
Quantity has been found more than 63% in excess. Had this willful and deliberate offence gone undetected the goods would have been released in garb of declared size , value and quantity and the Government would have suffered a loss of revenue amounting to Rs. 1,687,554. The value of the offending goods is Rs 2,161,314.
The importer was of the view point that it was the mistake of the shipper who shipped goods in wrong size and quantity.
Customs Adjudication observed that the goods are actually imported in excess quantity. Therefore, the importer has willfully and deliberately mis-declared the size and the quantity. Quantity has been found more than 63% in excess .Thus, the charges leveled in the show cause notice are found established. Therefore, the impugned goods are liable to be confiscated. However, an option to get the goods redeemed is given to the importer on the payment of redemption fine of 20% i.e. Rs. 4,32,263 and a personal penalty of Rs. 15,000 is also imposed on the trader.
