KARACHI: Justice Muhammad Junaid Ghaffar of High Court of Sindh (SHC) on Wednesday suspended a guideline issued by the Deputy Director Valuation in respect of Set Top Box/TV Tuners.
The bench earlier heard Talal Tariq advocate counsel for petitioner Dany Technologies, importer of TV Tuners from China.
The Secretary FBR, Collector Customs, Appraisement (West). Director Valuation and Deputy Director Valuation, Directorate General of Valuation are cited as respondents in the petition.
The petitioner maintains that Valuation guideline was issued illegally in the presence of Valuation Ruling in respect of STB/TV Tuners.
The respondent Deputy Director, Valuation in the impugned guideline held that declaration in respect of STB/TV Tuners are of wide range and do not correctly reflect value of the items as traded in the international market. STB without antenna fall under PCT heading 8528.7190 are being assessed under different value and certain transactions are on very low side.
After examining clearance data, market inquiries found that the custom value of Set Top Box/TV Tuner of Low End brands of China origin shall be US $ 7.40 per set (C&F) value, the guideline suspended on Wednesday said.
