KARACHI: A divisional bench of High Court of Sindh (SHC) comprising Chief Justice Sajjad Ali Shah and Justice Zulfiqar Ahmed Khan on Thursday ordered release of consignments of Aluminum Oxide SAII after payment of entire custom duty and other taxes.

The bench however ruled that Customs will return the amount if petitioner succeeded before tribunal. The bench earlier heard counsel for petitioner Ahmed Chemical Company which imported consignments from Fuji Kasei Company Ltd, Japan. The petitioner filed a GD for Home Consumption at a rate of US $ 0.70 per kilogram under HS Code 2818.2000 but the custom valuation issued a new Valuation Ruling 794/2016 dated 15-1-2016 fixing the value at US $ 1.40 per kilogram.

The bench after hearing the sides ordered that consignment be released if the petitioner pays entire amount of custom duty and taxes. At the same time, it was also ordered that custom would refund the same if petitioner succeeds before the Special Customs Appellate Tribunal.
