KARACHI: A customs appellate bench of High Court of Sindh (SHC) yesterday deferred hearing of a constitution till July 17 on request by counsel for respondent Karachi International Container Terminal seeking time to produce a responsible officer.
The bench earlier heard Miss Dil Khurram Shaheen advocate, counsel for Rising Sun Construction Company Limited which imported five prime movers which were detained by the Pakistan Customs.
A division bench of SHC in May 2018 allowing an interim arrangement ordered release of the prime movers. The vehicles could not be released as KICT raised a demand of rupees one crore as demuggrage.
Today the counsel for petitioner produced a small slip and contended that there was no proper system or procedure to determine the volume of demurrage.
She said that as per her calculation, demurrage come to around 7.7 million which her clients areready to pay.
The counsel appearing for the respondent KICT said that he needs to consult his clients. He under take to convey the offer and to ensure that a senior official of KICT to attend proceedings on next date and apprise the court whether the offer is acceptable to them.
The bench allowing the request adjourned further proceedings till July 17. The petitioner company has already paid all custom duties, taxes etc.
