KARACHI: A division bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Arshad Hussain Khan disposed of a constitution petition seeking directions to the chairman to expedite hearing of a petition delegating power to a member to heard and decide the controversy.
The bench was hearing a constitutional petition filed by the “Life Line Diagnostic Medical Centre”. According to details petitioner place was visited by a team of officials of Commissioner Inland Revenue. Zone II Assistant Deputy Commissioner Unit I, RTO III who passed an ex-parte order against the petitioner which was appealed before Commissioner (Appeals) which was dismissed. An appeal was then filed before Tribunal (IR) which granted a stay order on 2-2-2017 for 30 days. The petitioner was advised to approach the chairman Appellate Tribunal HQ Islamabad seeking urgent hearing of main appeal.
The petitioner prayed to the court that while there was no likely hood of hearing soon and it is apprehended that after expiry of 30 days period, respondents will enforce recovery coercively.
The SHC bench after hearing the sides directed the Chairman IR Appellate Tribunal to pass appropriate order at an early date saving the petitioner from coercive action.
The chairman may delegate authority to some senior member of the Appellate Tribunal at Karachi to enterain and decide the application for urgent hearing in case pending at Karachi bench (of the Appellate Tribunal), the bench ordered while disposing of the petition.
