KARACHI: Justice Zulfiqar Ahmed Khan OF High Court of Sindh (SHC) on Tuesday while hearing an application for urgent hearing filed by Pakistan Customs, HQRS fixed Jan 12 as date for hearing of the application in suit no 2767 of 2016 filed by Alpine Marine Services (Pvt) Ltd.

The cancellation of license of the plaintiff is the subject matter of the suit.

Today Masooda Siraj advocate appearing for the defendant custom officials maintained that plaintiff secured orders ex-parte by misguiding the court and making false statements.

She maintained that in fact Order in Original (ONO) was passed on 28-12-2016 and was conveyed to the plaintiff  side on the same day by the evening but suppressing/concealing this fact, plaintiff obtained an order of suspension from a single bench of SHC on 19-12-2016 suspending the operation of ONO.

The plaintiff side has the legal remedy of approaching the appellate forum within the hierarchy of custom department, she maintained.

The single judge today after hearing the counsel for customs while granting application for urgent hearing fixed Jan 12 as next date of hearing. The license of the plaintiff was cancelled after an Afghan national was found in the ship carrying goods of the principal brought in by the plaintiff marine services.
