KARACHI: A Special Customs Reference Application (SCRA) filed by Collector of Customs against Shahzada Alam and another in year 2015 was dismissed here on Monday by a customs appellate bench of High Court of Sindh (SHC) comprising Justice Agha Faisal and Justice Shah Nawaz Memon.
As the SCRA came up for hearing, Sardar Zafar Hussain made appearance for the Applicant Department while Muhammad Abbas Advocate appeared for the respondent Shahzada Alam and another.
The controversy pertains to imports of Self-adhesive PE clear transparent film with paper backing declared under PCT Heading 3919.1010 while customs classified it under PCT Heading 3919.9090.
The bench after hearing the contesting sides held that finding of the Customs Appellate Tribunal are correct in law. The bench answered the only question of law framed by it against the applicant department and in favor of the respondents while dismissing the SCRA in Limine.
