KARACHI: A constitutional bench of High Court of SIndh (SHC) comprising Justice Adnan-ul-Karim Memon and Justice Muhammad Jaffer Raza while issuing notices to Pakistan Customs for Aug 31, restrained them from encashing bank guarantee furnished by petitioner Murree Brewery Company Limited.
The bench earlier heard counsel from renowned law firm Franklin Law Associates representing the petitioner company. The counsel contended that application by petitioner company under Section 83-B of the Customs Act was decided and an Order in Original has been passed on 31-7-2026 against the petitioner.
The counsel from Franklin Law further contended that Order in Original has been assailed before the Customs Appellate Tribunal in Appeal No KO 961/ 2026 but respondents are in process of encashing the bank guarantee.
The bench after brief hearing ordered issuance of notices to the respondents for Aug 31 while restraining the respondents from encashing the bank guarantee.
