KARACHI: In a significant ruling today, the High Court of Sindh allowed a constitutional petition and quashed an FIR registered by the Customs Enforcement against Al Rahim Trading Company and High Speed Diesel (HSD) seized at N.M.B. Wharf, Karachi.
Justice presiding over the Constitutional Bench heard arguments from petitioner’s counsel Murtaza Wahab, while Dr. Shahab Imam represented Customs and Ms. Shazia Hanjra appeared as Deputy Attorney General, accompanied by Preventive Officer Osama Munim.
The court declared all actions including confiscation of oil tankers and HSD as illegal, while directing customs authorities to release the seized goods within 10 days upon the petitioner’s application.
“After hearing arguments and perusing the material available on record, the petition is allowed subject to any modification in a detailed order,” the court observed in its interim order.
Sources said Collector Customs Enforcement Umar Shafique will now approach Supreme Court of Pakistan.
Meanwhile, Faisal Ghani CEO of Franklin Law Associates has joined in and will represent the trading company at Adjudication level.
