KARACHI: A custom appellate bench of High Court of Sindh (SHC) comprising Justice Agha Faisal and Justice Jan Ali Junejo decided four identical appeals filed by Directorate of Intelligence & Investigations Karachi against Mansoor Store and others on the strength of order passed by Supreme Court of Pakistan in a case widely known and referred as Nestle Pakistan case.
As SCRAs came up for hearing Khalid Mehmood Rajpar Advocate appearing for the applicant department stated that these references are pending since 2023 and the respondent Mansoor Store is continuously avoiding adjudication. He further stated that service has been affected through publication and excerpts from relevant newspapers are on record.
Khalid Mehmood Rajpar further stated before the bench that questions involved in these appeals have already been decided by the apex court in a case cited as Nestle Pakistan Limited, 2025 SCMR-1974 and that it is squarely binding upon this court (SHC). He further prayed that question of law framed be decided in favor of the applicant department.
The bench agreeing to such arguments ordered disposal of SCRAs in terms of order in Nestle case.
