KARACHI: A constitutional petition filed by Messer’s Z.A. Brothers Lahore was disposed of by a constitutional bench of High Court of Sindh comprising Justice Adan-ul-Karim Memon and Justice Zulfiqar Ali Sangi after Customs counsel assured no-coercive action on the basis of impugned demand notices.

The petitioner company was represented by noted law firm Franklin Law Associates while respondent Collectorate of Custom (Appraisement) East was represented by Agha Shahid Majeed Khan.

As the matter was taken up counsel from law firm argued that petitioner who is importer of Thermo Plastic Polyurethane got its consignments released on the basis of accurate commercial documents on declared transactional value and there was no under valuation or mis-declaration as alleged in demand notices.

After arguing at some length both the sides agreed on the disposal of the petition in terms that no coercive action  will be taken by the respondent department on the basis of  demand notices. The counsel from Franklin Law Associates also relied upon order passed by SHC in petition CP-D-4994/2024.

The bench disposed of the petition in terms of above order which allows department to proceed in accordance with law. A copy of order follows separately.
