KARACHI: A constitutional bench of High Court of Sindh (SHC) comprising Justice Yousuf Ali Sayeed and Justice Muhammad Osman Ali Hadi disposed of a petition filed by Messer’s Elixir Marketing & Distribution Private Limited after assurance by Custom Authorities. Dr Shahab Imam represented the petitioner while Muhammad Khalil Dogar represented Pakistan Customs.
As the petition came up for hearing, counsel for Pakistan Customs submitted that Delay Detention Certificate issued in the matter is required to be implemented by the Port authorities. He undertook that Pakistan Customs would ensure its implementation in accordance with the principle laid down by the Supreme Court of Pakistan in Civil Appeal No 99/2025 titled Shaheen Airport Services (SAPS) V/s Yasir Traders & others where in apex court has held that it was mandatory upon port authorities to comply with such certificates.
The bench after this assurance observed that petition has served its purpose and thus disposed of.
