KARACHI: Notices were issued for March 13 to respondent Bin Wahid Traders and Wictor Trading Corporation for by a custom appellate bench of High Court of Sindh comprising Justice Agha Faisal and Justice Jawad Akbar Sarwana in two identical Special Customs Reference Application filed by Collector of Customs, Karachi. Sardar Zafar Hussain Advocate represented the applicant department.
As the SCRA’s No 886 and 887 of 2023 came up for hearing, the counsel for applicant department submitted that the impugned judgment by Customs Appellate Tribunal is not sustainable as it directed that the transactional value to be accepted under Section 25 (1) the Custom Act, whereas the recourse ought to have been for the valuation to be ascertained in accordance with law.
Sardar Zafar relied on a reported judgment 2023 PTD,1769 and prayed to the court to set aside the impugned judgment, remand the cases back for fresh adjudication.
The bench after a brief hearing and considering re-phrased questions of law ordered issuance of notice to the respondents for March 13. In the meanwhile, the SHC bench also suspended the impugned judgment passed on 28.11.2022.
