KARACHI: A custom appellate bench of High Court of Sindh (SHC) comprising Justice Agha Faisal and Justice Jawad Akbar Sarwana admitting two SCRAs filed by Pakistan Customs (Headquarters) against M/s Eagle Clearing & Forwarding Agency and M/s Fahad Impex ordered notices for March 09.

Agha Shahid Majeed Khan Advocate represented the Applicant department and presented four questions of law the fore most being that Whether the Tribunal erred in holding that digital/ WhatsApp evidence required mandatory forensic certification, despite Section 46 of Qanun-e-Shahadat order, 1984 read with Article 164 (Electronic Evidence) permitting reliance on electronic transaction data supported by circumstantial record?.

The bench while issuing notices the impugned judgments were suspended by the SHC bench.

Qanun-e-Shahadat order
