KARACHI: A custom appellate bench of High Court of Sindh (SHC) comprising Justice Agha Faisal and Justice Jawad Ahmed Sarwan dismissed a Special Custom Reference Application (SCRA) filed by Pakistan Customs Export Collectorate as Salman Afzal, Collector of Customs Export was unable to articulate any question of law and sought denovo adjudication of evidence which is perhaps not amenable in reference jurisdiction.
The SCRA was filed in 2018 through and eve notices were not sought by the applicant collectorate till year 2026 when finally on 22.01.2026 the court noted that counsel for the department was unable to assist the court regarding the questions of law arising out of impugned judgment of Custom Appellate Tribunal.
The bench in view of inability of the Export Collectorate to canvas its case dismissed the same for non–prosecution.
