KARACHI: Hearing a constitutional petition filed by Khawja Enterprises, importer of Chloroform ordered Director, Directorate General of Valuation to decide the matter within 90 days without being influenced by impugned Addendum dated 08.08.2025.

The Addendum was passed while the said officer was under transfer and notification of his transfer was issued on 7-8-2023 (Notification – Transfer/Posting No 1803-C, dated 07.08.2025) It is also note worthy that no Valuation Ruling was issued for the said item after 2020 (VR 1480 of 2020 dated 22-10-2020).

The case was heard by a two member bench of SHC comprising Justice Adnan Iqbal Chaudhry and Justice Muhammad Jaffer Raza. Rana Sakhawat Ali Advocate appeared for the petitioner while Khalid Mehmood Rajpar and Sardar Zafar Hussain Advocate represented the  respondent custom officers.

The bench after hearing the counsels at length ordered that respondent no 3 shall provide a hearing to the Petitioner along with other stakeholders before determining the Valuation Ruling in respect of subject goods and pass a ruling expeditiously in accordance with law. The bench also fixed a time limit of 90 days to decide the matter.

As per details, Custom Valuation ordered determination of value of Chloroform packed in Drums at a rate of US $ 120 PMT and in ISO/Flexi Tanks at US $ 70 PMT, a huge difference in value which according to petitioner made his business un-competitive.
