KARACHI: A customs bench of High Court of Sindh comprising Justice Adnan Iqbal Chaudhry and Justice Muhammad Tahir Raza partly allowed a petition filed by M/s Jalal Brother through Shahab Imam Advocate ordering the petitioner to deposit amounts of adjudged custom duty and taxes with the department and fine and penalty before the Nazir of SHC.
The bench heard counsel for petitioner who submitted that Deputy Collector (Adjudication) has passed on Order in Original dated 24.11.2025 ordering confiscation of goods on the charge of misdeclaration. However an option of redemption was given to the petitioner. The said order is under challenged in an appeal before the Customs Appellate Tribunal, Karachi bench. The counsel submitted that he confines petition to the relief of release of goods by way of securing the disputed amount with SHC.
Sardar Zafar Hussain counsel for Pakistan Customs submitted that entire amount adjudged should be paid to the department.
The bench after hearing the sides formed a view that since Petitioner’s appeal is yet to be decided by the Tribunal it would be unjust to condition the release of goods on the payment of impugned fine and penalty. The bench then ordered petitioner to pay undisputed amount of duty and taxes to the department while secure amount of fine and penalty before the Nazir of SHC in the form of a pay order or bank guarantee and further ordered that security shall be subject to further orders of the Court.
