KARACHI: A custom appellate bench of High Court of Sindh SHC comprising Justice Adnan Iqbal Chaudhry and Justice Muhammad Jaffer Raza ordered release of a consignment of cut pieces of textile fabric against securing of amount of duty and taxes with the Nazir of the Court.

The bench was hearing a constitutional petition filed by M/s S.H & Sons through Rana Sakhawat Ali Advocate.

The counsel for the petitioner company submitted that the cut pieces of textile fabric were assessed under Valuation Ruling which is applicable only to fabric that is not cut into pieces and therefore the an order of provisional release would not be hit by the case of Collector of  Customs Lahore versus Waseem Radio Traders or Shamim Ahmed versus Federation of Pakistan.

The bench after hearing counsel for Pakistan Customs Sardar Zafar Hussain and Muhammad Ahmed Assistant Attorney General for Pakistan disposed off the petition noting that the appeal is pending against assessment and therefore it can be disposed off if Petitioner secures disputed amount of duty and taxes with the Nazir of SHC through a Pay Order of Bank Guarantee.
