KARACHI: A custom appellate bench of High Court of Sindh (SHC) admitting three Special Customs Reference Applications (SCRA’s) filed by Pakistan Customs through Advocate Sardar Zafar Hussain suspended the operation of order of Customs Appellate Tribunal while ordering issuance of notices for Dec 17.
Earlier the bench heard the counsel for customs who argued that the customs appellate tribunal decided three appeals K 3439, 3440 and 3441 through a common order without any independent deliberation therefore impugned order cannot be considered a speaking order. He argued that even facts and circumstances of each case were not mentioned in the impugned judgment and are wrongly clubbed which is not befitting a last fact finding forum.
The bench after hearing brief arguments admitted the SCRAs, suspended the judgment and fixed the hearing for Dec 17.
