KARACHI: A divisional bench of High Court of Sindh (SHC) comprising Justice Adnan Iqbal Chaudhry and Justice Muhammad Jaffer Raza restrained Collectorate of Customs (Appraisement) East from encashing security deposited by Messer’s Shakir Engineering, Karachi. Dr Shahab Imam represented the petitioner company while department was represented by Agha Shahid Majeed Khan.
As the petition was taken up counsel for the departmental officers filed para wise comments. The counsel for petitioner submitted that after the petition was filed, a Public Notice No 14/2025 dated 25.09.2025 was issued by the Classification Committee which supported the departments stance on classification of subject goods i.e agricultural machinery parts. However subsequently the FBR set aside the said Public Notice No 14/2025 and remanded the matter to the Classification Committee for reconsideration.
The bench noted that in view of above the question of classification of Petitioner’s good is pending before the Classification Committee. The bench while disposing of the petition restrained the respondent Collector and Assistant Collector from encashing Pay Order furnished by the petitioner company until decision of the Classification Committee.
