KARACHI: A constitutional bench of High Court of Sindh SHC comprising Justice Agha Faisal and Justice Muhammad Osman Ali Hadi dismissed six identical SCRA’s filed by Directorate of Transit Trade filed in year 2017.
As the applications were taken up Ms Afseen Aman advocate appearing for the applicant department submitted that the questions raised in these reference applications have been decided against the department vide orders of this court on 24.2.2021 in SCRA 91 of 2015 and 29.2.2024 passed in SCRA 47 of 2022.
She further submitted that aforementioned orders are squarely binding on this court and in mutatis mutandis these reference application may be dismissed in limine.
The bench allowed the request and dismissed all the SCRAs directing its office to send the order to the Customs Appellate Tribunal and also to place the order in connected matters.
