KARACHI: A petition filed by Tradewings Enterprises was partly allowed by a custom appellate bench of High Court of Sindh comprising Justice Adnan Iqbal chaudhry and Justice Muhammad Jaffer Raza directing the petitioner to deposit amount of duty and taxes with the department whereas the amount of fine and penalty be secured with the Nazir of Sindh High Court.

The bench heard Aneel Zia ans Saima Syed Advocates appearing for the petitioner company who submitted that Additional Collector (Adjudication) passed Order in Original against the company on 20.10.2025 holding that goods are liable to be confiscated on the charge of mis-declaration. However an option of redemption of goods was given to the Petitioner company. The Petitioner has filed an appeal against Order in Original in Custom Appeal No K-1532/2025. Aneel Zia Advocate submitted that he is confining this petition to the relief of release of goods pending appeal by way of securing the disputed amount with this Court.

Sardar Zafar Hussain Advocate representing Pakistan Customs opposed the prayer and said that entire amount adjudged should be paid to the department.

The bench after hearing held that in view of appeal is pending and finding of misdeclaration is yet to be decided by the Custom Appellate Tribunal it would be unjust to condition the release of goods on payment of impugned fine and penalty. The bench allowed the petition directing the petitioner to deposit the amount of duty and taxes with the department while amount of fine and penalty shall be secured with the Nazir of SHC by way of pay order or bank guarantee. The bench further ordered that security shall be subject to the outcome of the appeal pending before the tribunal.
