KARACHI: A constitutional bench of High Court of Sindh ordered release of a vessel Al-Danish-1 owned by a petitioner Muhammad Bilal.
The bench heard Shahab Imam Advocate, counsel for the petitioner briefly and counsel for Karachi Port Trust who filed a statement reflecting that petitioner’s vessel is detained due to non-payment of penalty levied under the KPT Act 1886.
In response Shahab Imam Advocate placed on record a statement which exhibits that all such penalties imposed have been paid by the petitioner. He further submitted that payment was made without prejudice to the petitioner’s right and now there is no impediment for the boat to sail.
The bench after perusing the papers ordered that if the petitioner has paid penalities on rates imposed under the KPT Act, KPT shall release the vessel and issue the requisite permits.
The bench ordered to relist the petition after ten days.
