KARACHI: A custom appellate bench of High Court of Sindh (SHC) comprising Justice Agha Faisal and Justice Muhammad Usman Ali Hadi admitted two connected Special Customs Reference Applications (SCRA’s) filed by Collector of Customs (West) against one Ijaz Ahmed and ordered issuance of notices to the respondent for Oct 22.
Earlier Sardar Zafar Hussain advocate appeared for the applicant department and submitted that impugned judgment by Special Customs Appellate Tribunal is prima facie devoid of any independent deliberation or reasoning. He submitted that the judgment entirely comprised of reproduction and a dissonant conclusion and cannot be considered as speaking order. The bench said that contentions need consideration.
The bench then while admitting the reference applications ordered issuance of notices to the respondent for 22-10-2025 while suspending operation of the impugned judgment in Custom Appeal No K-3611 and K-3643 of 2024.
