KARACHI: Hearing a Special Custom Reference Application (SCRA) filed by Model Customs Collectorate (Appriasment) East, a custom appellate bench of High Court of Sind ordered issuance of notices to respondent A.S Autos for Oct 13, 2025. The SCRA was filed in year 2020 (SCRA 115/2020).
Earlier Sardar Zafar Hussain Advocate filed vakalatnama on behalf of the applicant department.
He pressed the following question of law
Whether in the presence of “Classification Committee”decision on the same issue, the Honorable Customs Appellate Tribunal has not erred in law to set aside the Classification Committee Decision under Section 194-B of the Custom Act 1969 on unsunstantiated plea that the Classification Committee has not disclosed some vital points.?
The counsel for the applicant department also contended that the issue had already been decided in a judgment reported as 2025 PTD260.
The bench after initial hearing ordered issuance of notice to the importer / respondent for Oct 13.
