KARACHI: A custom appellate bench of High Court of Sindh allowed a petition filed by SA Ceramics Private Limited to the extent of release of goods against payment of customs duty and taxes with the department and security before the Nazir of the court in relation to fine and penalty. Franklin Law Associates represented the petitioner.  

The petitioner imported a consignment of Gypsum but customs confiscated the goods on charge of mis-declaration. However option of redemption was given to the importer.

The petitioner through Franklin Law Associates challenged the Order in Original by filing Custom Appeal No K-1226/2025 which is pending. A lawyer from the noted law firm representing the petitioner submitted that he is confining the petition to the relief of release of goods pending appeal by way of securing the disputed amount with SHC.

The counsel for the respondent customs pleaded for payment of entire amount as ordered in ONO but the bench after hearing the sides as a measure of interim relief ordered release of goods if petitioner secures duty and taxes with the department and amount of fine and penalty with the Nazir of SHC. The amount secured with the Nazir of SHC was subjected to the outcome of the appeal pending before the Customs Appellate Tribunal.
