KARACHI: A custom appellate bench of High Court of Sindh comprising Justice Adnan Iqbal Chaudhry and Justice Jaffer Raza disposed of a petition filed by M/s Adia Enterprises through Proprietor Muhammad Ashfaq Khan and Ghous Bux Shipping Service, directing the Additional Collector of Customs (Appraisement) West to decide application under section 79(1) in respect of 5 containers of second hand clothing.

The bench earlier the parties. Khalid Mehmood Rajpar, counsel for Pakistan Customs expressed reservations on the conduct of Petitioner No.1 against whom FIRs of misdeclaration are pending. The counsel however submitted that to the extent of processing the application U/s 79(1) he has no issue.

After this statement, the bench disposed of the petition directing the respondent no 2 Additional Collector of Customs, Appraisement, West to decide the application within a week time. The bench also restrained the department from any proceedings against the petitioner in relation with 5 consignments for which the application is pending.

Mean while Muhammad Ashfaq Khan S/o Ajab Dad Khan was admitted to interim bail against surety of rupees 200,000 in four different case FIRs.
