KARACHI: A constitutional bench of High Court of Sindh (SHC) comprising Justice Zulfiqar Ali Sangi and Justice Nisar Ahmed Bhanbhro dismissed a petition filed by Messer’s PSRM (Pvt) Ltd challenging a notice issued by Collector of Customs MCC-Appraisement (East) for encashment of security deposit of Rupees 8,200,000.

The amount pertains to Custom Duty and other leviables against import of Double Girder Overhead Cranes. The petitioner claims exemption from duty and taxes declined by the custom authorities. The matter is presently being heard  by the Appellate Authority.

The bench after hearing Adeel Awan Advocate, counsel for the petitioner company held that custom officer is empowered to encash the security against government dues and if the Appellate authority rules in favor of the petitioner company the amount  recovered will be refunded.
