KARACHI: Hearing a constitutional petition filed by M/s Nexcell Technologies Private Limited, a custom appellate bench of High Court of Sindh comprising Justice Muhammad Karim Khan Agha and Justice Adnan-ul-Karim Memon ordered Sardar Zafar Hussain Advocate to file a statement that Custom Appellate Tribunal is fully functional or not.
Sardar Zafar who represents Pakistan Customs was asked to specifically mention that whether Member Judicial and Member Technical are available to hear appeals.
The bench then adjourned further proceedings in the petition till 30.6.2025.
It is worth mentioning that lawyer for Pakistan Customs raised the issue of jurisdiction maintaining that while the importers/petitioners while appeal before the tribunal and then rush to Sindh High Court for relief in the form of provisional release.
This was abuse of process of law, Sardar Zafar submitted at which the bench passed the above order aimed at curbing the un-necessary litigation at High Court level.
