KARACHI: A constitutional bench of High Court of Sindh headed by Justice Agha Faisal dismissed a number of petitions filed M/s Abdullah & Co, Pakistan Synthetic Limited and others after bench was informed that controversy already been decided by this Court as well as Supreme Court of Pakistan.

Sardar Zafar Hussain Advocate appearing for the respondent Pakistan Customs at the outset of hearing stated that controversy in this case has been decided by a bench of SHC in case 2024, PTD, 736 title Shamim Ahmed & Others.

It was pointed out that counsel for petitioner is not present despite fixed date. It was further contended that Supreme Court has also determined the said controversy in case known as Collector of Customs, Lahore versus Wasim Radio Traders (2023 SCMR 1716. The bench observing that decision of apex court is binding dismissed the petitions.

The issue before the court was that whether the imported goods can be released by passing an interim order while decision on challenge to Valuation Ruling is pending before the Director General (Valuation) or Custom Appellate tribunal.
