KARACHI: Lahore High Court (LHC) hearing a constitution petition challenging the vires of rule 101A and 105 of Custom Rules ordered issuance of the notices to respondents as well as Attorney General of Pakistan.
Lahore Customs Agents Association filed the petition through Junaid Jabbar Khan ASC challenging the recent amendment inserting the impugned rules in Custom rule 2001 vide notification dated 24.12.2024. It was contended that impugned rules are in conflict with the provision of section 32 of the Custom Act 1969 wherein mechanism of imposing specific penalties has already been prescribed.
The LHC bench comprising Justice Muhammad Sajid Mehmood Sethi after initial hearing ordered issuance of notices to the respondent as well as Attorney General of Pakistan in terms of Order XXVII-A of CPC.
