KARACHI: The prima facie attempt to deceive the Appellate bench of High Court of Sindh headed by Acting Chief Justice Muhammad Junaid Ghaffar landed Mr. Zahid MAsood, Chief Commissioner IRS, Karachi into trouble as SHC in its order has hinted at initiating proceedings against him.
The Chief Commissioner was directed to be in attendance on 15-4-2025 for proceedings in the matter. The bench was hearing a petition filed by Farha Talib Ovais Ali Shah Advocate who challenges an Order in Revision arising out of an order of suspension followed by black-listing proceedings.
The petitioners Revision Application under section 21(5) of the Sales Tax Act 1990 has been disposed of merely on the ground that the concerned Commissioner after suspension of Sales Tax registration has initiated blacklisting proceedings which are pending and hence no revisional order could be passed in respect of suspension of STRN as the said proceedings have not culminated.
The bench rejections contention of Chief Commissioner held that no one can be left remediless. The bench noted that conduct of the Chief Commissioner are an attempt to deceive the court by un-necessary dragging the matter and leaving the Petitioner remediless till such time the blacklisting proceedings are finalized. The bench further noted that Chief Commissioner has been vested with revisional powers to redress the grievance of the aggreieve tax payer and not to drag them with such orders. It was further heck that authority does not want to work and decide the issue of suspension on the pre-text that the blacklisting is still pending.
