KARACHI: The custom appellate bench of High Court of Sindh (SHC) comprising Acting Chief Justice Muhammad Junaid Ghaffar and Justice Mohammad Abdur Rahman sets aside another judgment of Custom Appellate Tribunal and remanded back for a well reasoned judgment containing determination of factual aspects.
This time the applicant was Model Custom Collectorate, Appraisement (East) represented by Khalid Mehmood Rajpar Advocate against Messer’s Assabeqoon.
The bench noted that tribunal apparently not dialted upon the facts nor on law and has passed the judgment in a slipshod and perfunctory manner.
The said order is third in a row when the SHC setting aside the order of the Appellate tribunal, a federal government institution, remanded the case back for rehearing and passing a well reasoned order considering factual controversy involved. This amply shows the inability of the appellate tribunal in passing orders strictly as per facts, merit and sound reasons.
